1. Acceptance of Terms
By accessing our website or using the services provided by Genesee County Mobile Notary Services ("Company," "we," "our," or "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.
2. Services Provided
We provide the following services:
- Mobile notary services throughout Genesee County and surrounding areas
- Fingerprinting services using traditional ink and roll methods
- Document witnessing and authentication
- Emergency and same-day notarization services
3. Service Requirements
For Notary Services
- All signers must be present at the time of notarization
- Valid, unexpired photo identification is required for all signers
- Documents must be complete and ready for signing
- Signers must be competent and alert
- Signers must be able to communicate in English or provide a translator
- Signers must understand the nature and significance of the document
For Fingerprinting Services
- Valid photo identification is required
- Hands must be clean and free of cuts or injuries that may affect print quality
- FBI FD-258 cards will be provided
4. Pricing and Payment
Current Rates
- Mobile Notary Service: $75.00 (up to 1 hour service)
- Fingerprinting Service: $75.00 (first FBI FD-258 card)
- Additional Fingerprint Cards: $25.00 each
Payment Terms
- Payment is required in full before services are rendered
- We accept cash, check, and major credit cards
- Additional fees may apply for waiting time beyond 10 minutes if documents or persons are not ready
- Emergency and same-day services may incur additional charges
- Travel fees may apply for locations outside our standard service area
5. Scheduling and Cancellations
Appointments
- Appointments should be scheduled at least 24 hours in advance when possible
- Same-day and emergency appointments are available but may incur additional fees
- We will confirm all appointments via phone or email
Cancellations
- Cancellations must be made at least 2 hours before the scheduled appointment
- Late cancellations or no-shows may result in a cancellation fee
- We reserve the right to reschedule appointments due to weather or other circumstances beyond our control
6. Limitations and Refusal of Service
We reserve the right to refuse service in the following circumstances:
- Incomplete or improperly prepared documents
- Signers who appear to be under duress or coercion
- Signers who are not competent or appear to be under the influence
- Invalid or expired identification
- Documents that appear to be fraudulent or illegal
- Situations that violate notary laws or regulations
- Unsafe or inappropriate locations
7. Liability and Disclaimers
Service Limitations
Our notary services are limited to witnessing signatures, verifying identity, and administering oaths. We do not provide legal advice, prepare documents, or guarantee the legal validity of documents.
Limitation of Liability
Our liability is limited to the amount paid for our services. We are not responsible for any consequential, indirect, or punitive damages arising from the use of our services.
Fingerprinting Disclaimer
While we strive for high-quality fingerprints with a low rejection rate, we cannot guarantee acceptance by receiving agencies. Factors such as skin condition, age, and occupation may affect print quality.
8. Record Keeping and Confidentiality
We maintain records of all notarial acts as required by Michigan law. All client information is kept confidential and secure. Records may be disclosed only as required by law or court order.
9. Professional Standards
Our notaries are commissioned by the State of Michigan and adhere to all applicable laws and regulations. We maintain professional liability insurance and follow industry best practices.
10. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of Genesee County Mobile Notary Services and is protected by copyright and trademark laws.
11. Governing Law
These Terms are governed by the laws of the State of Michigan. Any disputes will be resolved in the courts of Genesee County, Michigan.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on our website and will be effective immediately upon posting. Continued use of our services constitutes acceptance of the modified Terms.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
